To
finish up our review of the exclusive dealing provision, let us consider
what it means for you.
It does not mean that you or VFS can never impose
conditions or restrictions on the supply of a particular product or service.
Sometimes this may be appropriate. For example, we may require a customer
to take out insurance as a condition of their loan. It is not appropriate
however, to require this customer to take out insurance with a particular
person or institution. This activity is prohibited under the Trade Practices
Act.
It may not be easy to work out whether any particular exclusive dealing
arrangement could result in a substantial lessening of competition in
the relevant market. For this reason if you are ever concerned about the
possibility, discuss the proposed arrangement with your supervisor.
