OHS practices - Fundamentals
WorkCover
WorkCover inspectors have the power to enter any workplace at any time and conduct investigations to see whether OHS standards laid down in legislation are being complied with.
Among other functions, inspectors:
- can issue written directions and stop work orders through a Provisional Improvement Notice (PIN)
- are required to take all reasonable steps to notify the employer and any OHS representatives upon entering a workplace. They must give both the employer and the OHS representative information about observations and action proposed to be taken by the inspector
- respond to appeals following the issue of a PIN and to arbitrate in the event of a cease-work
- can take samples and photographs as required, but must notify the OHS representative and employer when this is done
- can initiate court proceedings for any breach of regulations.
