Age discrimination

Age-related discrimination includes:

  • Age-based bullying
  • Lack of promotion and training
  • Lack of access to flexible work arrangements
  • Pressure to retire

Gender discrimination

The Sex Discrimination Act 1984 gives effect to Australia’s international human rights obligations and protects people from discrimination on the basis of their sex, sexual orientation, gender identity, intersex status, marital or relationship status, pregnancy and breastfeeding. 

Religious belief or activity

It is against the law to discriminate against a person because of their religious beliefs or activities.

Disability

It is against the law to discriminate against a person because a person has a disability. If a person can do all of the essential functions of a job, except for those their disability prevents them from performing, then disability laws require that the employer provides the person with a disability with a "reasonable accommodation."

Reasonable accommodation is an adjustment or modification provided by an employer to allow a person with a disability to enjoy equal employment opportunities as individuals without disabilities.

Reasonable accommodation includes:

  • Making existing employee facilities accessible to, and usable by, people with disabilities
  • Job restructuring or modifying work schedules
  • Acquiring or modifying equipment or devices.

Sexual harassment

Sexual harassment is an unwelcome sexual advance, unwelcome request for sexual favours or other unwelcome conduct of a sexual nature which makes a person feel offended, humiliated and/or intimidated, where a reasonable person would anticipate that reaction in the circumstances.
